Terms & Conditions

Applicable to Denmark and Sweden

Governing law: Danish law (subject to mandatory consumer protection in the user’s country of residence)

1. Scope and Definitions

1.1. These terms (“Terms”) apply to the use of Delebox, a self-service digital solution for lending, renting, and purchasing equipment and consumables.
1.2. The Delebox app (“the App”) is the official mobile application through which access, booking, payment, and communication take place.
1.3. A User is a natural person who has created an account in the App, accepted the Terms, and registered a valid payment card.
1.4. The User must be at least 18 years old or otherwise have full legal capacity under applicable law.

2. Access and Authorization

2.1. The App can be downloaded free of charge. Account creation requires registration of a payment card with 3D Secure.
2.2. A User is considered authorized when the User has:

  • created an account in the App
  • accepted the Terms
  • registered a valid payment card

2.3. Access to a specific Delebox requires that the User has physical access to the location. Physical access is managed by the owner of the box (e.g. a housing association) or Nortec.
2.4. Nortec may restrict or terminate access to the Service at any time.

3. Lending, Renting, and Purchasing

3.1. Through the App, the User may borrow or rent equipment and purchase certain goods (“purchase items”).
3.2. Purchase items are physical products taken from the Delebox and registered as a purchase upon removal.
3.3. Purchases of purchase items are considered sales of goods. The right of withdrawal may be limited or waived if:

  • the item has been used
  • seals have been broken
  • the item cannot be returned for hygiene, safety, or health reasons

4. Delivery and Inspection

4.1. Equipment is released via QR code scanning and registered automatically.
4.2. The User must actively report defects or deficiencies in the App within 5 minutes of removal.
4.3. Failure to report within 5 minutes, combined with actual use of the equipment, constitutes acceptance of its condition.

5. Return

5.1. Equipment must be returned on time and in the same condition as at delivery, except for normal wear and tear.
5.2. Missing or late returns may result in fees and/or compensation claims.

6. Liability – Overview

The same liability rules apply whether equipment is provided free of charge (loan) or against payment (rental).

7. Damage to the Equipment

7.1. The User is liable for damage, loss, or theft of the equipment.
7.2. Compensation is calculated as repair or replacement with an equivalent new product.
7.3. Liability cap:
The User’s liability is limited to the new value of the equipment + DKK 1,500, unless the damage is caused by intent or gross negligence.

8. Damage Caused During Use

8.1. The User is liable for damage caused by the use of the equipment, including damage to:

  • buildings
  • installations
  • fixtures
  • third-party property

8.2. Nortec is not liable for such damage unless otherwise required by mandatory law.

9. Disclaimer of Liability

9.1. Use of the equipment is at the User’s own risk.
9.2. Nortec disclaims, to the fullest extent permitted by law, liability for:

  • personal injury
  • damage to buildings or third parties
  • indirect losses, loss of profits, or consequential damages

10. Insurance

10.1. The User may purchase insurance via the App.
10.2. The insurance may cover damage, loss, and theft in accordance with separate insurance terms.
10.3. The insurance does not cover misuse or gross negligence.

11. Prices, Fees, and Payment

11.1. Payment is charged automatically to the registered payment card.
11.2. Nortec may charge rental fees, service fees, compensation, and deductibles.
11.3. An updated and complete overview of prices, fees, and liability limits is available in the App before booking.
11.4. Nortec may reject the use of a payment card in the App but cannot block the card with the card issuer.

12. Breach

In case of breach, Nortec may:

  • block the User’s account
  • reject payment cards
  • charge fees
  • report the matter to housing associations and/or authorities

13. Data and Monitoring

13.1. Personal data is processed in accordance with GDPR.
13.2. Limited video surveillance of the Delebox may take place for security reasons.
13.3. Data is stored only as long as necessary and lawful.

14. Force Majeure

Nortec is not liable for failure to perform due to circumstances beyond Nortec’s control, including power outages, network failures, vandalism, government actions, or force majeure.

15. Amendments

15.1. The Terms may be amended with 30 days’ notice via the App and email.
15.2. Continued use after entry into force constitutes acceptance.

16. Complaints and Disputes

16.1. The User may submit complaints to Nortec.
16.2. Danish consumers may complain to Nævnenes Hus.
16.3. Swedish consumers may complain to Allmänna reklamationsnämnden (ARN).

17. Governing Law and Jurisdiction

17.1. The agreement is governed by Danish law.
17.2. Mandatory consumer protection in the User’s country of residence applies.

Privacy Policy

This privacy policy describes how Nortec A/S (“Nortec”, “we”, “us”) processes personal data in connection with the use of Delebox and the Delebox app (“the App”).

2. When This Privacy Policy Applies

This privacy policy applies when you:

  • create a user account in the App
  • book, borrow, rent, or purchase equipment via Delebox
  • use a physical Delebox
  • communicate with Nortec via the App or support

By creating an account, you accept this privacy policy.

3. Personal Data We Process

3.1 Information you provide

  • name
  • email address
  • phone number
  • payment information (tokenised card data – not full card numbers)

3.2 Data generated through use

  • booking and loan data
  • pickup and return times
  • selected equipment and purchases
  • event and error logs
  • communication with support

3.3 Technical and security-related data

  • access logs (e.g. opening of Delebox)
  • sensor data (e.g. weight, status)
  • limited camera recordings from the Delebox area

Camera recordings are used solely for security, prevention of misuse, and documentation of incidents and are not intended for facial identification during normal use.

4. Purpose of Processing

We process personal data to:

  • deliver and operate Delebox and the App
  • carry out lending, rental, and purchases
  • manage payments and fees
  • prevent and investigate misuse, theft, and vandalism
  • ensure operations, troubleshooting, and technical stability
  • comply with legal obligations
  • provide customer support

With your consent, data may also be used for:

  • operational notifications
  • improving the user experience

5. Legal Basis

Processing is based on:

  • Art. 6(1)(b) GDPR – performance of a contract
  • Art. 6(1)(c) GDPR – legal obligations
  • Art. 6(1)(f) GDPR – legitimate interests (security, misuse prevention)
  • Art. 6(1)(a) GDPR – consent (where required)

6. Video Surveillance

Video surveillance may occur in and around the Delebox.

Purpose:

  • prevention and investigation of theft and misuse
  • documentation in case of disputes
  • protection of equipment and installations

Recordings are generally stored for 30 days but may be kept longer if required due to:

  • ongoing disputes
  • insurance cases
  • police reports
  • legal requirements

Recordings may be disclosed to:

  • relevant data processors
  • insurance companies
  • police, where required or permitted by law

7. Disclosure and Data Processors

We may disclose personal data to:

  • payment providers
  • cloud and hosting providers
  • technical operations partners
  • housing associations (limited and only where relevant)

All data processors are subject to data processing agreements in accordance with GDPR.

8. Transfers to Third Countries

Personal data is generally processed within the EU/EEA.
Exceptional transfers outside the EU/EEA occur only to:

  • countries approved by the European Commission, or
  • under Standard Contractual Clauses (SCC)

9. Retention and Deletion

Data is stored as necessary for the purpose:

  • booking and event data: up to 3 years
  • video recordings: 30–90 days
  • accounting and payment data: 5 years (Bookkeeping Act)
  • inactive accounts: deleted after 12 months

Certain data may be retained longer if required by law or to protect Nortec’s legitimate interests.

10. Your Rights

You have the right to:

  • access your personal data
  • rectification
  • erasure (subject to legal retention requirements)
  • restriction of processing
  • data portability
  • object to processing based on legitimate interest
  • withdraw consent

We may update this privacy policy. Material changes will be notified via the App or email.
